How Do I Know If I Have a Case?

If you or a family member have been diagnosed with mesothelioma, a rare and aggressive form of cancer, you may be able to pursue legal action.

However, this question is difficult to answer definitively as each case is different. This is why we encourage you to contact a St. Paul mesothelioma attorney from our firm to review your situation during a free consultation.

There are several sources of information we would need to review, including:

  • Medical records that describe your mesothelioma diagnosis
  • Documentation related to your work history
  • Other job history details, such as when you may have worked with materials containing asbestos
  • Any evidence that shows your former employer used asbestos-containing products
  • Whether former coworkers have developed mesothelioma or have filed a case

What is My Mesothelioma Case Worth?

Determining how much your potential case may be worth will depend on a number of variables unique to your mesothelioma diagnosis. This includes looking at the amount and duration of your asbestos exposure, the costs of related medical care, and financial losses from being unable to work.

If we determine your claim has merit and you decide to take legal action, we are prepared to help you pursue compensation for:

  • Cost of chemotherapy and radiation
  • Cost of surgeries
  • Imaging tests (MRIs, X-rays, CT scans)
  • Palliative care
  • Medical assistive devices
  • Pain and suffering
  • Loss of income
  • Loss of earning capacity

Generally, there are two options available for pursing compensation for a mesothelioma case:

  • Asbestos trusts – If a company is accountable for you and other former coworkers developing an asbestos-related disease, like mesothelioma, you could be eligible to pursue compensation from a special trust fund. These funds are managed by a trustee whose duty it is to determine the value of each case filed. Certain medical criteria must be met to quality for compensation.
  • Mesothelioma lawsuits – In the event your former employer does not have a trust fund set up, you may be able to file a mesothelioma lawsuit as long as the company has not filed for bankruptcy. You may even be offered to settle out of court. We recommend consulting with a mesothelioma injury attorney to determine if the settlement offered is just and fair.

If no settlement is reached, our attorneys are prepared to go to court if necessary. We have a proven track record of recovering maximum compensation for our clients. Let us help you out with the legal process.

Is There a Time Limit to File a Case?

According to state law, you typically have two years after the date of the diagnosis to file a mesothelioma case in Minnesota. Claimants who attempt to file after this deadline run the risk of having the case barred by the court. However, there may be some exceptions that require you to file before or after that time.

If you are not sure if your filing deadline has passed, we recommend that you speak with one of our licensed Saint Paul mesothelioma lawyers to find out what time frame applies to your situation.

Mesothelioma Cases We Handle

At TSR Injury Law, we are prepared to handle a wide variety of mesothelioma cases. The four main types of mesothelioma include:

Pleural Mesothelioma

This is the most commonly-diagnosed type of mesothelioma, representing between 70 to 75 percent of cases. The tumor develops in the pleural lining, affecting both the chest and lungs. Victims with pleural mesothelioma often experience difficulty breathing, chest pain, unexpected weight loss, fever and fatigue. Life expectancy with treatment is about three years at Stage 1 and about 12 months to a year at Stage 4.

Peritoneal Mesothelioma

This type of mesothelioma represents between 10 to 20 percent of cases. The tumor develops in the lining of the peritoneum or abdomen. Victims with this disease often experience pain and swelling of the abdomen, bloating, decreased appetite and bowel changes. Life expectancy is at least five years in more than half of the victims (52 percent) who undergo surgery with heated chemotherapy.

Pericardial Mesothelioma

This type of mesothelioma is extremely rare with only about 200 cases reported. The tumor develops in the lining of the pericardium or heart. Victims with pericardial mesothelioma often experience an irregular heartbeat, chest pain, breathing problems and persistent coughing. Life expectancy is between six weeks and up to 15 months with surgery.

Testicular Mesothelioma

This is the rarest type of mesothelioma with no more than 100 cases reported. The tumor develops in the lining covering the testes. Victims with this disease often experience scrotal swelling and painless testicular lumps. Life expectancy is about two or more years with surgery and chemotherapy.

Different Symptoms Of Mesothelioma

Mesothelioma caused by asbestos exposure usually takes 20 to 50 years to develop. This can make it difficult to diagnose victims at an early stage, which is why the disease is often discovered too late.

While mesothelioma symptoms can vary, the most common include:

  • Difficulty breathing
  • Chest pain
  • Dry cough or wheezing
  • Abdominal pain
  • Fever
  • Weight loss
  • Fatigue
  • Muscle weakness
  • Breathing problems
  • Buildup of fluid around the lungs
  • Blood clots
  • Coughing up blood

There is, unfortunately, no cure for mesothelioma. However, early detection and treatment could help extend one’s life expectancy. It is important that you talk with a doctor to better understand your medical options.
