Who Can File a Wrongful Death Claim in Minnesota?

When a person dies, their next of kin may be entitled to compensation. Here is how the legal process works in Minnesota:

• The Trustee: A court-appointed trustee manages the claim for all family members. This person is responsible for bringing the claim, accepting or rejecting settlement offers, and dividing the recovery based on each person’s loss.
• Court Approval: A judge must give final approval on how the settlement money is distributed among the next of kin.

Minnesota’s Wrongful Death Statute of Limitations

Most wrongful death claims in Minnesota must be filed within three years of the date of  death, but exceptions can shorten or extend that timeline depending on the circumstances.
