Proven Results in Wrongful Death Cases

Our work on fatal and catastrophic cases includes:

  • Multimillion Dollar Settlement: A TSR client was killed when hit by a tractor chopper without its lights on and ran over his car.
  • Confidential Settlement: A TSR client  was hit when a semi-truck failed to wait until fog lifted, causing the fatality of a young adult.
  • $1,000,000: A TSR client was killed when an at fault driver took a left in front of her during a blinking yellow light.

Every case is different, but these results show the level of care, investigation, and advocacy we bring to families seeking justice.

What Counts as Wrongful Death in Minnesota?

Under Minnesota Statutes §573.02, a wrongful death occurs when someone’s life is taken because another person – or entity – acted negligently or wrongfully. Families can pursue a claim when preventable negligence leads to fatal injuries, including:

Motor vehicle crashes

Deadly collisions caused by speeding, distracted driving, drunk driving, failure to yield, unsafe passing, and especially crashes involving commercial trucks.

Slip and fall incidents

Fatal falls caused by wet floors, uneven surfaces, broken railings, unsafe stairs, or property owners who fail to correct or warn about dangerous conditions.

Workplace or industrial accidents

Construction and manufacturing workers are exposed to heavy machinery, heights, defective equipment, electrical hazards, and other risks that can lead to fatal injuries.

Motorcycle crashes

Lane-change collisions, tailgating, left-turn accidents, and road hazards often cause life-ending trauma to motorcyclists.

Medical malpractice

Misdiagnosis, delayed treatment, surgical errors, medication mistakes, or failure to follow proper procedures can lead to preventable death.

If you believe your loved one’s death could have been avoided, TSR can evaluate whether negligence is present and explain the legal path available to your family.

Who Can File a Wrongful Death Claim in Minnesota?

When a person dies, their next of kin may be entitled to compensation. Here is how the legal process works in Minnesota:

  • The Trustee: A court-appointed trustee manages the claim for all family members. This person is responsible for bringing the claim, accepting or rejecting settlement offers, and dividing the recovery based on each person’s loss.
  • Court Approval: A judge must give final approval on how the settlement money is distributed among the next of kin.

What Your Family Must Prove

Wrongful death cases require the same elements of negligence found in personal injury cases:

  1. Duty of care: The responsible party had a legal obligation to act safely.
  2. Breach of duty: They failed to meet that obligation.
  3. Causation: That failure directly caused the death.
  4. Damages: The family suffered measurable losses.

These cases involve significant evidence, expert analysis, and legal nuance. TSR’s wrongful death team handles the investigation so your family doesn’t have to.

Damages Available in a Wrongful Death Case

Minnesota allows families to recover both economic and non-economic losses, such as:

  • Medical care before death
  • Funeral and burial expenses
  • Loss of income, wages, and future earning capacity
  • Loss of household services, benefits, or inheritance
  • Pain and suffering experienced by the deceased
  • Loss of companionship, care, guidance, and emotional support

Courts consider factors such as the decedent’s age, health, life expectancy, occupation, earnings, habits, and contributions to the family.

TSR works with economists, medical professionals, and experts to determine full and fair compensation.

Conscious Pain and Suffering

For decades, Minnesota law contained an injustice that most people never knew about — until it happened to a loved one. If you were seriously injured because of someone else’s negligence, and you suffered for minutes or even years before you died, your family could not recover compensation for what you went through. This is typically referred to as pain and suffering damages.

TSR Injury Law played a pivotal role in changing the law to allow conscious pain and suffering damages to be recovered in wrongful death claims. The legislature amended both Section 573.01 and 573.02 of the Minnesota Statutes. The key revision to the wrongful death statute now expressly allows recovery for all damages suffered by the decedent resulting from the injury prior to the decedent’s death — not merely the family’s loss related to losing a loved one. Insurance companies can no longer get away with not paying for the pain and suffering caused by their insureds just because the injured party dies. TSR is proud of our work to make the law in Minnesota more just with the recent changes in the wrongful death statutes.

Minnesota’s Wrongful Death Statute of Limitations

Most wrongful death claims in Minnesota must be filed within three years of the date of death, but exceptions can shorten or extend that timeline depending on the circumstances.

Missing the deadline means losing the ability to pursue compensation entirely.

TSR can confirm the deadline that applies to your case during a free consultation.
