The Spine and Ruptured Discs
The spine is literally the backbone of good health. The vertebrae are critical in the weight-bearing capacity of the spine and provide protection and support for the spinal cord — which is a bundle of nerves connecting the brain to the entire body, facilitating all movement and organ function.
Between every vertebrae is a small, gel-filled cartilage disc that provides a cushion between the segments of the spine. When the spine is damaged or stressed in a car accident or severe fall, the disc can rupture. A ruptured disc bulges out, sometimes irritating or pressing directly on a nerve. A ruptured disc (disk) may be referred to as a herniated disc, slipped disc, or a bulging disc.
Ruptured Disc Symptoms
The symptoms of a ruptured disc vary, but may include the following:
- swelling
- back pain
- muscle weakness
- tingling
- decreased reflexes
- pain radiating into a limb
In some cases, a spinal injury will interfere with bowel and bladder function. If that happens, seek immediate medical attention because this is not a normal ruptured disc symptom.

Toyota 2010 Prius Recall – Prius Brake Failure – Lexus HS 250h Recalled
Saturday, February 6th, 2010
Toyota — the company that stood for quality — the company that could do no wrong — has major problems. Their seemingly invincible reputation is at stake. Xinhus News agency reported Saturday that Toyota of Japan has issued a mandatory recall of 270,000 units of its third-generation (2010) Prius hybrid car. It has officially been recalled in the United States now. The Lexus HS 250h is included in this recall because it has a similar component design to the 2010 Prius.
There have been more than 100 complaints and 4 accidents related to Toyota Prius brake failure. Toyota has admitted to a design failure in the anti-lock braking system. The brakes were designed to prevent skidding. Now the company is on a skid, with no end in sight.
Call (612) TSR-TIME for help with your Toyota Car Accident.
Toyota Prius Problems
Many 2010 Prius owners have reported that the brakes do not consistently engage when the brake pedal is pressed. The National Highway Traffic Safety Administration is assessing the scope of the problem. The NHTSA will look into reported momentary loss of braking capabilities.
The investigation comes as safety questions surround Toyota, which has already issued broad recalls for millions of its best-selling vehicles, including the Corolla and Camry, initially labeling the problem as being with the floor mats moving forward to press on the accelerator pedal. Ultimately, the recall was due to a design flaw with the gas pedal that allowed friction to build and the pedal to become stuck.
Toyota said it would unveil safety measures relating to the Prius brakes as soon as a new design is available. Most auto and safety experts are questioning Toyota’s integrity. They feel that Toyota has not disclosed the full extent of its safety flaws.
Minnesota Toyota Recall Lawyer
Having a recall on your car is unnerving. It can undermine your confidence in the integrity of your vehicle. It may even change the way you live and drive — making you stay home more often, making you drive more tentatively, and even altering how you react in a crash-avoidance maneuver.
We want to help you in your fight for justice with the Toyota design defect, especially if the design defect led to a car accident. Call (612) TSR-TIME | No Fee Until We Win

Two Injured in Car – Light Rail Train Crash
Wednesday, December 30th, 2009
A car collided with a light-rail train in Bloomington Monday afternoon. The driver of the car and a train passenger were transported to the hospital with neck and back injuries.
A spokesman for Metro Transit reported that the driver of the train was able to slow down before the crash, but could not stop the train in time. The Chevrolet Malibu was exiting from eastbound Interstate 494, toward 34th Avenue South, when the brakes failed. The woman driving was not able to stop and crossed the path of the southbound Hiawatha Line train.
Metro Transit is investigating the incident, but it appears the car’s mechanical failures are to blame.

Minnesota Broken Hip
In the United States, nearly 300,000 people are hospitalized every year with a broken hip. Most of the time the hip is broken near the upper leg where the femur meets the hip. Knee, thigh, and hip injuries have increased in frequency in auto accidents, to about 14,000 a year, because airbags now offer more protection for the head and chest.
There are two kinds of hip fractures:
- femoral neck fracture – where the ball-and-socket hip joint is broken off the femur, the severity of dislocation can vary greatly
- intertrochanteric hip fractures – this type of break is below the femoral neck and is usually easier to repair with the use of plates and screws
Treatment of a broken hip usually requires surgery, which can be effective. But statistics show that only 25% of the people that sustain a broken hip make a full recovery and complications can be life-threatening. The complications include:
- nonunion – where the fracture does not heal
- malunion – where the break heals in a distorted position
- avascular necrosis – lack of blood supply
- wound infection
- blood clots
- implant failure
- mal-positioning of the implant

A broken hip can limit your mobility and ability to earn a living. If your broken hip was the result of negligence on the part of another, call TSR Injury Law today for free legal advice.

Broken Arm
The arm is made up of bones that can be broken in many different ways. The radius and ulna are the long bones below the elbow. There is just one bone above the elbow — the humerus.
A broken arm can occur in a car accident, truck accident, or slip and fall accident. Surgery is frequently required to stabilize the arm, especially if it is an open fracture. With an open fracture, a specialist will have to do a neurological exam and a vascular exam to check for nerve damage or compromised blood vessels. Often times, the extent of damage cannot be determined until surgery.
If a broken arm is suspected, take these steps to help ease the pain until medical help arrives:
- Try to keep the arm motionless.
- Keep the arm elevated above heart level to minimize swelling.
- If the bone is protruding, cover it to keep it clean. NEVER try to put a fractured bone back into position.
Treatment for a Broken Arm
Basically, there are two options for treating a broken arm — internally (surgery) or externally (cast or splint). There are many types of casts or splints depending on the amount of support needed during healing.
In order for the arm to heal properly, the following are recommended:
- During the first few days, continue to elevate the injured area to minimize swelling and pain. An ice pack can also be applied for short periods of time throughout the day. Keep a thin barrier (like a towel) between the ice pack and the cast.
- Keep all areas of the cast or splint dry at all times. Cover with a plastic bag and tape securely while bathing. Should it become damp, dry gently with a hair dryer.
- Never put powder or anti-itch ointment inside the cast.
- Never try to scratch inside the cast.
- Report any tingling, numbness, unusual swelling, or skin irritations. These symptoms may mean the cast is too tight.
Recovery may take anywhere from a few weeks to several months depending on the severity of the break. Keep these tips in mind to facilitate a full recovery:
- Never remove the cast or splint unless instructed by your doctor.
- Do not expect to return to normal activity immediately after the cast is removed. Take it slow and give the joints and muscles time to strengthen.
- Do physical therapy as prescribed.

Monday, December 14th, 2009
Three people from one family were killed Saturday night in a head on collision. The accident occurred about 7 p.m. on County Road 50, near Kenwood Trail, Lakeville.
The crash involved a Hyundai Elantra, driven by Debra Buhmann, and a Chevy Silverado, driven by a 17-year-old from Dundas, Minnesota. It was reported that the Silverado was being driven with its lights off and went over the center line, crashing head on into the Elantra.
The car was carrying three generations from one family; Shirley Iverson, 71, Debra Buhmann, 34, and Alexis Iverson, 8. They all lost their lives in the crash that occurred just miles from their homes. The driver of the pickup truck was airlifted to HCMC, his condition unknown.
Lakeville Police and the Minnesota State Patrol are investigating the accident. Alcohol is not suspected.
Minnesota Wrongful Death Attorney
In this type of car crash, if the truck was being driven with its lights off, there is a strong case for a wrongful death suit due to negligence. A wrongful death suit must be filed by a family member and brought to court by a trustee. The compensation is limited to financial losses suffered by the surviving family members and includes: loss of companionship; loss of assistance, advice, and protection; and loss of monetary contributions the deceased would have made had they lived.
The laws dealing with a wrongful death suit are complex. Therefore, it is important to retain an experienced, knowledgeable law firm to represent you in your Minnesota wrongful death claim. Our personal injury lawyers have decades of combined experience. We will fight for justice in your case. Contact a Minnesota Wrongful Death Attorney at 612-362-0000.

Any accident is traumatic. A multi-car crash is terrifying. With a rear-end collision, very frequently victims sustain soft tissue injuries. Soft tissue injuries can be difficult to proof. The insurance companies will do everything in their power to destroy your claim — they will question your integrity and the competency of your doctors. You need legal representation to ensure that you receive fair compensation for your medical expenses, lost wages, and pain and suffering.

TSR Injury Law Partner Chuck Slane Obtains Favorable Verdict
Wednesday, November 18th, 2009Bloomington, MN (PRWEB) November 18, 2009 — Chuck Slane, TSR Injury Law Partner and Minnesota Top 40 Plaintiff’s Attorney, represented William Kieper for injuries suffered in a car crash in Burnsville, Minnesota, January, 17, 2006.
Minnesota Personal Injury Attorney Chuck Slane tried the case of Kieper v. Shea to a Dakota County jury in October (case #19HA-CV-09-61). The case involved a client who underwent spinal fusion surgery as a result of a car crash. The crash was caused by inattention; Defendant Shea simply drove into the back of Kieper’s vehicle.
Shea and her insurance carrier, State Farm, claimed the crash was caused by ice. Furthermore, they claimed the crash was unavoidable. However, on the eve of trial, that defense was abandoned and liability was admitted. Instead they argued that the surgery was the result of pre-existing degenerative changes rather than the crash.
The insurance company offered only $15,000 until the eve of trial at which point they raised the offer to $90,000. After a week-long trial, the jury provided $200,000 of compensation to Kieper.

Evidence in Minnesota Wrongful Death Case
Sunday, August 16th, 2009
Feeling all alone and overwhelmed? We care and want to help. If you hire TSR Injury Law, we will gather the evidence, contact needed expert witnesses, handle all of the paperwork, and file your claim. Call us today at 612-362-0000 and one of our experienced wrongful death attorneys will fight for justice in your case.
Aspects of Wrongful Death Case
Three criteria has to be met to establish a wrongful death. They are:
- a human death occurred
- that death was caused by the wrongful act, negligence, omission of a person or corporation
- financial or emotional loss was suffered by the beneficiaries due to the Minnesota wrongful death
In order to prove fault in a wrongful death case, witness supported evidence is necessary. The evidence presented by the plaintiff must be sufficient and compelling to convince the judge or jury to rule favorably. Witnesses must be willing to testify. Then they need to relate exactly what they saw or heard pertaining to the death. Physical evidence will be gathered, including:
- medical reports
- corroborative witness testimonies
- police reports
Expert witness evidence can be invaluable to further explain issues that may not be obvious or discernible to the judge or jury. Expert witnesses are often used in product liability, vehicle safety, and workplace safety cases.
Potential damages evidence has to be presented to prove to the judge or jury that a recovery is just and fitting. Some documentation that is beneficial:
- bank records
- business sales journals
- business profit and loss reports
- employer records

Be sure to get the driver’s name and phone number, as well as their insurance provider and the provider’s phone number. You should also get names and phone numbers from anyone who witnessed the accident.
If you are contacted by the negligent driver’s insurance adjuster, you may want to consider contacting a Minnesota Auto Insurance Claim Attorney before you speak with the adjuster.
Do not sign any forms without checking with an experienced attorney. You may be signing away your rights to a fair settlement.
How a Minnesota Auto Insurance Claim Attorney Can Help
The truth is that insurance companies are not primarily concerned with helping you.
The insurance company would like to minimize the payment you receive in order to maximize their profits. An experienced attorney can advise you on your legal rights and ensure that you do not commit costly mistakes during the claims process. If necessary, your attorney can also help you take legal action against an insurance company that refuses to treat you fairly.
To speak with an experienced Minnesota Auto Insurance Claim Attorney, contact TSR Injury Law at (612) TSR-TIME today or submit our consultation form. Our attorneys are ready to put their skill and expertise to work for you. We care and we can help.

Minnesota Accident Attorney Testimonials
Thursday, April 30th, 2009
“I was hit by a drunk driver, which shattered my knee. To make matters worse, I was pregnant and close to delivery. I needed help and felt helpless in the hospital. One of the surgery nurses even advised that I should not call an attorney because all I would get is $30,000 and he will take half!”
“Thankfully, I didn’t listen to her and I called Steve. He came to my room and everything got easier. All my questions were answered and his firm exceeded my wildest expectations.”
In short order, Steve:
- Doubled my insurance, retroactively with American Family, to pay for my surgery and get me double wage loss and at home service help,
- Found the drunk and got coverage established,
- Documented my surgery with blown up x-rays and got me a check for $100,000.00 within a few months.”
“Steve was always there to answer questions and walk me through the complicated legal maneuvering of both my insurance and the drunk’s. We are now working with my insurance for the next layer of coverage, which I didn’t even know I had!”
Amy Welshons, Stillwater
“I was a young lady when I got in a car crash. A friend rolled the truck we were in. I had immediate injuries and went by ambulance to the hospital. My father thought we could work with the insurance company on our own. We were wrong. The experience I had with my own insurance bordered on craziness! We hired TSR Injury Law to level the playing field. Steve said it was the worst case of insurance abuse he had ever seen.
In short order after we hired his firm, Steve won every bill owed, got the insurance company to apologize for their conduct and settled my case for the maximum amount of coverage. While all this was happening in my life, my father got sick and Steve even sent him flowers. I have never heard of that from any law firm.”
Jessy, Plymouth
“My name is Pemba Tsering. I am originally from Tibet. I sustained a serious injury to my knee when my bicycle was struck head on by a taxicab. I was riding my bicycle home after finishing work at my second full time job. I was in the bicycle lane when the taxicab illegally passed another vehicle and collided head on with my bicycle. My kneecap was shattered, my thumb was broken and I had a serious concussion. I was off work for months, and I will never return to my second full-time job.
The insurance carrier refused to settle my case. They claimed my injuries were not serious and that the accident was my fault. Chuck took my case to trial, and a jury awarded damages in the amount of $520,000. Before trial the insurance company made an offer of $50,000. Chuck was not afraid to take the case to trial. Maybe next time the insurance carrier will think twice before refusing to treat people fairly.”
Pemba Tsering, Minnesota
“My name is Brent Larson. In November of 2000, I was on my way home after picking up dinner for my family when I was struck by another vehicle that ran a stop sign. I was seriously injured. My spleen was ruptured and it had to be removed. My ankle was shattered and required several surgeries. I also had nerve damage that affected the use of my hand and arm. After the accident, I learned that the person that hit me was drunk, and it was his third drunk driving violation.
As a result of my injuries, I had to sell my home and move my family into my mother’s home. It was a very difficult time for my family and me. Chuck was able to help me through this difficult time and answer all of my questions. When my case was complete, I was able to purchase a new home for my family to live in.”
Brent Larson, North St. Paul
“My name is Joe Spelios. In May of 1997 I was seriously hurt in a workplace accident. I was working for a friend’s company that installed loading dock doors. We were on a work site in Rochester when an unmarked can started on fire. I attempted to remove this can from under a desk and became engulfed in flames. I was burnt over 34% of my body. My medical bills alone exceeded $100,000.
I hired a lawyer to help with the case, but he did not do anything. I waited for a long time for him to get the case settled. After I decided to change lawyers, he informed me that he had received an offer to settle for $25,000.
I hired Chuck Slane to take over the case. He immediately discussed the case with the insurance adjuster and was told, “Sometimes cases are just not good cases and they need to be settled.”
Chuck started a lawsuit and began re-creating the file from scratch. That was necessary because my first lawyer lost my file. It was discovered that the Defendant had made a habit of keeping an uncovered, unlabeled can of flammable solvent under his desk. Rules required that the solvent be in a covered can with a label, and that it should be stored in the paint vault.
After we discovered this information the insurance company raised their offer to $100,000, but they still denied any responsibility for the accident.
Chuck and I decided to go to trial and let a jury decide what a fair settlement would be. After a week long trial, the jury found the Defendant to be 100% responsible for the accident and awarded damages in the amount of $1,934,000.
I am very satisfied with the work of the firm, TSR Injury Law, and I would recommend them to anyone that needs a personal injury lawyer.”
Joe Spelios, Bethel
“I broke my shoulder in three places when I fell in front of my apartment building. I am legally blind and therefore I must utilize different friends for everyday activities. I was concerned about hiring a lawyer because I needed someone I could trust. Steve came to my apartment and spent two hours discussing my case. The City of Minnesota did not want to pay my medical bills or accept responsibility, so I asked Steve to start a lawsuit. The case finally resolved and I can truly say that I am satisfied with the result and my continued friendship with Steve.”
Gretchen Goss, Minnesota
“I was a passenger in a friend’s car that hit a tree. I fractured my pelvis and hurt my neck and back. I felt bad about “suing” my friend but the medical bills mounted and I was off work. To make matters worse, I was pregnant and concerned about giving birth with a broken pelvis.
I called TSR Injury Law. Steve explained that we would not have to “sue” anyone. In fact, my case was settled with my friend’s insurance. Steve also found another layer of insurance coverage because the crash had some unique facts. We were able to settle with the second insurance carrier also and still keep my medical bill coverage open. Steve understood the human side of the case and did not start a lawsuit just to do it. He listened to my concerns and followed my input. I took less in the settlement, but am happy because I am still friends with the driver.”
Sarah, Bloomington
“In November of 1998 I was hit by a drunk driver and sustained injuries to my neck and back that required a neck fusion in 2001. The complex process of getting what you can out of insurance companies was handled in a professional, diligent matter by Steve and his team over a 4 ½ year time frame. Throughout this time I was kept well informed of the progress of my case and had complete confidence that Steve had everything under control. Because of his efforts, I never had to worry about the $50,000 in medical bills, time off work, and the never-ending battle with the drunk’s insurance and my insurance company. In the summer of 2003, my insurance company made an offer the week before our scheduled arbitration date but we hung in there; and with Steve’s skill we ended up receiving all but $3000 of my insurance policy limits. Who you are as a person does not matter to any insurance company so it pays to shop for a lawyer when you are injured. In my opinion you do not need to look any further than TSR Injury Law. I would highly recommend Steve and his team at TSR Injury Law.”
Clay, Edina
“My wife and I were ‘t-boned’ in downtown Minnesota. My wife, Darlene, knew she was hurt immediately, but I thought everything was okay. Unfortunately, I began to feel the affects of the collision a few weeks later and decided to seek treatment. At the same time, my insurance company started calling my home asking questions which I had no idea how to answer and they sent paperwork that I was uncomfortable signing. I hired TSR Injury Law to help. They were referred by a friend who was happy with their services.
Steven fought my insurance to pay the surgery bills, as well as the insurance of the person who hit us. I was amazed at how complicated the insurance companies tried to make the crash. The end result was Steven won the case on both sides. He got all my bills and wages paid and we settled the claim so that I was compensated for the pain and suffering. Based on this wonderful experience with Steve, I have referred him co-workers and family members who need legal help. I can not recommend anyone higher than TSR Injury Law.”
Curtis Bell, Maple Grove
“In February of 1997, I broke my elbow and tore the ACL, PCL, and Meniscus on my left knee due to a fall. Because of a suggestion from an acquaintance, I went with another law firm for my case. Unfortunately, they never returned calls and did not explain what was happening with my case. After my frustration grew, I switched to TSR Injury Law.
I had worries about bills, two surgeries, and lost time from work. As an executive in the housing industry, it was difficult to miss so much work. Steven Terry walked me through the entire process, including litigation, answering all of my questions and calming my nerves. We eventually settled, after a complete denial by the insurance company, and I can honestly say that I am happy with the end result as well as my experience with TSR Injury Law.”
James Watt, Bloomington

- Bourne v. Wente, verdict for $48,000 for a young lady with a muscular injury. The insurance company offered $5,000;
- Spelios v. Crenlo, verdict for $1,934,000.00 for a man that had been burned over 34% of his body. The insurance company offered $100,000.

- Guderian v. Walters Recycling, verdict for $128,000 for a lady with a compression fracture in her spine. The insurance company offered $5,000.
Chuck went to law school at William Mitchell College of Law. He graduated with honors in 1996. He then began his practice at the firm of Meshbesher, Birrell & Dunlap. He is now a partner at the firm TSR Injury Law, where he is the head of the litigation department.
