He was hospitalized and will probably remain in the hospital until Tuesday. A full recover is expected. The boy was rescued by his mother and one of her friends. Both the mother and the friend sustained injuries. The friend’s injury required stitches.

The Minnesota dog bite statute is one of the most liberal. It is designed to protect the innocent from dog bites.

Minn. Stat. Ann. sec. 347.22: Damages, owner liable.

  • If a dog, without provocation, attacks or injures any person who is acting peaceably in any place where the person may lawfully be, the owner of the dog is liable in damages to the person so attacked or injured to the full amount of the injury sustained. The term “owner” includes any person harboring or keeping a dog but the owner shall be primarily liable. The term “dog” includes both male and female of the canine species.

In essence, if you were not trespassing or provoking the dog, the owner is liable for all medical expenses, loss wages, and pain and suffering.
