New “Intersection Gridlock” Law Passed Against Blocking Intersections

Minnesota drivers must be extra careful in 2011 when it comes to facing gridlock traffic. Blocking an intersection will become illegal in 2011 with a new law recently passed. The new law aims to stop intersection gridlock and the car accidents that follow. Minnesota intersection gridlock prevention will make it illegal to run through a yellow or even green light if they cannot make it out of the intersection. What this means is that drivers must stop if they cannot make it through the entire intersection, regardless of what color the traffic light is.

Blocking Intersection Law

The new law, known as “intersection gridlock” is referenced as Minn. Stat. §MS 169.15 and came into effect in January 2011.  For drivers out there, the main catch of the new law is simple: Do not enter an intersection until you can make it all the way through

2 Killed, Semi Truck Chain Reaction Crash Lakeville, MN

car-crash-2 2 Killed, Semi Truck Chain Reaction Crash Lakeville, MN 4-vehicle chain reaction crash in Lakeville, Minnesota killed two Monday. A semi truck and 2 cars were stopped in the northbound lanes on I-35, near Highway 70, when another semi approached and was unable to stop, slamming into the vehicles. The force of impact pushed the two cars into the lead semi truck, crushing them. The semi truck was carrying beehives with millions of bees.

A driver of one of the cars was pronounced dead at the scene. The other car driver was air-lifted to North Memorial Hospital where she died Monday evening. Recovery attempts were hampered by the swarm of bees at the scene.

According to the State Patrol report, 50-year-old Pamela Brinkhaus, Elko, died at the scene and 24-year-old Kari Rasmussen, St. Anthony, died as a result of her injuries, at North Memorial Hospital. It was reported on the news that Ms. Rasmussen was pregnant.

The driver of the semi involved was Jason Styrbicky, 36, Buffalo. The accident is still under investigation.

6 Killed in Head-On Collision Cambridge, Minnesota

car-crash-9 6 Killed in Head-On Collision Cambridge, Minnesota Tragedy struck early Sunday morning near Cambridge, Minnesota. A newly-licensed, 16-year-old-driver hit another vehicle at 2:40 a.m. The teen driver survived, but the four passengers in her vehicle died; as did the the two occupants of the other vehicle.

The 16-year-old was traveling east on Hwy 95, driving a 1998 Pontiac Grand Am, when she struck a westbound 2000 Oldsmobile Bravada. The roads were wet at the time of the crash. The name of the teen driver has not been released, because she is a minor and there is the possibility of criminal charges being brought against her.

The passengers in the Grand Am were: Kelsee Blackledge, 15; Stephen Kendryna, 16; Travis Buchan, 17; and Travis Gryczkowski, 21. The names of the deceased in the Bravada have not been released pending identification.

The Minnesota State Patrol was on the scene with the Braham Police Department, Cambridge Police Department, Isanti County Sheriff Office, and the Isanti Police Department. The driver of the Grand Am was wearing a seatbelt, but it appears that the other occupants were not buckled up. The accident is under investigation to see if alcohol played a role in the crash.

This was the third crash this weekend involving teen drivers on Minnesota roads. All three of the crashes involved fatalities.

MN School Bus Crash: 8 Dassel-Cokato Students Injured

bus-accident-1 MN School Bus Crash: 8 Dassel-Cokato Students InjuredA Dassel-Cokato school bus crash near Kingston injured 8 students Friday morning. The State Patrol reported the crash occurred at 7:15 a.m., at Highway 15 and County Road 21, north of Dassel.

There was dense fog with visibility less than 200′ at the time of the accident. The Dassel-Cokato School Bus, driven by John Rokala, 78, stopped at the stop sign, then proceeded to cross Highway 15. The school bus was hit by a 2004 Chevrolet pick-up truck driven by Daniel Schneider, 28, of Kimball.

According to the State Patrol report, there were 17 students on the bus. Two students were taken to a Litchfield hospital and six were taken to a hospital in Hutchinson. None of the injuries were life-threatening. The drivers of the bus and pickup truck also had minor injuries.

Meeker County Sheriff’s office and the State Patrol were on the scene investigating the crash. Because the crash involved a school bus, investigators will thoroughly inspect the bus. Personnel from Dassel Fire and Rescue squads, Watkins – Cokato ambulances, and Gold Cross Ambulance also responded.

Their seemingly invincible reputation is at stake. Xinhus News agency reported Saturday that Toyota of Japan has issued a mandatory recall of 270,000 units of its third-generation (2010) Prius hybrid car. It has officially been recalled in the United States now. The Lexus HS 250h is included in this recall because it has a similar component design to the 2010 Prius.

There have been more than 100 complaints and 4 accidents related to Toyota Prius brake failure. Toyota has admitted to a design failure in the anti-lock braking system. The brakes were designed to prevent skidding. Now the company is on a skid, with no end in sight.

Toyota Prius Problems

Many 2010 Prius owners have reported that the brakes do not consistently engage when the brake pedal is pressed. The National Highway Traffic Safety Administration is assessing the scope of the problem. The NHTSA will look into reported momentary loss of braking capabilities.

The investigation comes as safety questions surround Toyota, which has already issued broad recalls for millions of its best-selling vehicles, including the Corolla and Camry, initially labeling the problem as being with the floor mats moving forward to press on the accelerator pedal. Ultimately, the recall was due to a design flaw with the gas pedal that allowed friction to build and the pedal to become stuck.

Toyota said it would unveil safety measures relating to the Prius brakes as soon as a new design is available. Most auto and safety experts are questioning Toyota’s integrity. They feel that Toyota has not disclosed the full extent of its safety flaws.

Head On Collision Kills 2 on Hwy 70, Pine County, Drunk Driving

minnesota-car-crash-1 Head On Collision Kills 2 on Hwy 70, Pine County, Drunk DrivingA New Year’s Day crash left 2 dead.

Scott Heckel, 44, of Pine City, was driving his 1995 Chevrolet GMT-400 east on Hwy 70 and attempted to pass in a no-passing zone. He crashed into a westbound 1999 Oldsmobile Intrigue, killing the driver and passenger. The deceased are Michael Moris, 50, and Robin Moris, 48, both of Pine City.

The GMT-400 then slid into the eastbound lane and side swiped a 1999 Dodge Caravan, sending it into the ditch. The driver, Patricia Denn, and passenger, Matthew Denn, sustained minor injuries. Heckel is in serious condition.

The accident is under investigation by Minnesota State Patrol and Pine County Sheriff’s Office. Alcohol is suspected and charges are pending.

ambulance-2 Two Injured in Car - Light Rail Train CrashA car collided with a light-rail train in Bloomington Monday afternoon. The driver of the car and a train passenger were transported to the hospital with neck and back injuries.

A spokesman for Metro Transit reported that the driver of the train was able to slow down before the crash, but could not stop the train in time. The Chevrolet Malibu was exiting from eastbound Interstate 494, toward 34th Avenue South, when the brakes failed. The woman driving was not able to stop and crossed the path of the southbound Hiawatha Line train.

Metro Transit is investigating the incident, but it appears the car’s mechanical failures are to blame.

Christmas Eve Drunk Driver Killed 88-Year-Old Man in Lakeville, MN

car-crash-7 Christmas Eve Drunk Driver Killed 88-Year-Old Man in Lakeville, MNJeffery Arthur Martin, 37, was charged for driving drunk and causing a collision that led to the death of an 88-year-old man on Christmas Eve.

The accident took place at Dodd Blvd and Gerdine Avenue, Lakeville. Martin was driving a Dodge Durango, and turned left onto westbound Dodd, crashing into the Cadillac driven by Susan M. Shaffer, 69, of Prior Lake.

Shaffer was taken to Regions Hospital in St. Paul, where she is still in serious condition. Her husband, Everett Letterly, 88, was taken to Regions and died on Christmas Day. Martin was not injured nor was his 9-year-old child, who was in the car with him.

Martin failed the preliminary breath test and was arrested at the scene. Monday he was charged in Dakota County District Court with drunken driving and child endangerment in connection with the collision. Dakota County Attorney James Backstrom said more charges may follow.

The accident is under further investigation by Dakota County Officers.

According to the Minnesota State Patrol website, a 2000 Chevrolet Cavalier was traveling eastbound on Minnesota Hwy 135 west of Gilbert, at 12:20 a.m. The Cavalier was in the westbound lane, passing vehicles, when it struck a 2003 Chevrolet Avalanche heading west.

At least one person was seriously injured in the car crash. Officials have not released their identities or conditions. The website classified the crash as a serious injury accident.

There were multiple police departments working at the car crash site, including officers from Eveleth, Gilbert, and Virginia. The St. Louis County Sheriff’s Office and Minnesota State Patrol were also called to the scene. The car crash did not appear to be weather-related.

car-crash-11 3 Killed, 1 Injured in Lakeville, MN Head On CollisionThree people from one family were killed Saturday night in a head on collision. The accident occurred about 7 p.m. on County Road 50, near Kenwood Trail, Lakeville.

The crash involved a Hyundai Elantra, driven by Debra Buhmann, and a Chevy Silverado, driven by a 17-year-old from Dundas, Minnesota. It was reported that the Silverado was being driven with its lights off and went over the center line, crashing head on into the Elantra.

The car was carrying three generations from one family; Shirley Iverson, 71, Debra Buhmann, 34, and Alexis Iverson, 8. They all lost their lives in the crash that occurred just miles from their homes. The driver of the pickup truck was airlifted to HCMC, his condition unknown.

Lakeville Police and the Minnesota State Patrol are investigating the accident. Alcohol is not suspected.

roseville-car-crash-1 Roseville, MN 7 Car Crash Leaves 1 Dead At 4 p.m. today, a minivan crashed into a line of vehicles stopped at a red light, setting off a chain reaction. In total, seven vehicles where involved in the crash. One woman died and the driver of the minivan is in critical condition at Regions Hospital, St. Paul.

According to Roseville Police, six vehicles were heading west on County Road C and stopped for a red light at Snelling Avenue. A white minivan, also heading west and driven by a man who is suspected of having a medical problem, approached at a high rate of speed and was not able to stop.

The first vehicle that was hit by the van was being driven by a woman from Montrose. That woman died at the scene.

The Roseville Police and Minnesota State Patrol were on the scene. The accident will be reconstructed and investigated. Alcohol is not suspected in the crash. Names of victims have not been released.

The 3 people in the Mini Cooper were taken to Regions Hospital where they were treated and released. The seatbelts and airbags protected the occupants from more serious injury.

The ladder truck was heading west on Randolph shortly after 5 a.m., responding to a call related to an electrical outage in the area. The traffic lights were not working and the fire truck hit the car in the intersection. At the time of the crash, both vehicles were going about 25 mph, according to Dave Galbraith, deputy chief of the St. Paul Fire Department.

The intersection was dark because of a downed wire at Cretin and St. Clair Avenues. 2,500 Xcel Energy customers were without power Friday morning, according to Mary Sandok, a spokesperson for Xcel Energy.

Ruby Voight had just gone shopping. She was walking home at about 5:15 p.m. with her packages in the basket of her walker. The 1996 Chevy Tahoe, driven by 55-year-old David Rostomily, was driving westbound on Hwy 12. Ruby was in the crosswalk at Johnson Avenue NW when she was struck.

Wright County Sheriff’s Office and the State Patrol were at the scene. They will continue to investigate the accident. Alcohol does not appear to be a factor. Mr. Rostomily stopped and is cooperating with authorities.

car-crash-6 Fatal Crash in St. Michael, MinnesotaLast weekend brought to light again the need for stiffer penalties for drunk driving. There was another needless death. A multiple repeat-offender was apparently driving drunk again, crashed into a vehicle, killing the 17-year-old driver.

Todd Lifto, 44, drove his 2001 Chevrolet Silverado pickup the wrong way on County Road 35, with no headlights — and speeding. He crashed into the 1998 Toyota Camry that Jonathon Kramnic was driving. Jonathon was airlifted to North Memorial Medical Center, Robbinsdale, where he died Sunday.

The crash occurred on Saturday about 6:30 p.m., on County 35, near Jamison Avenue, in St. Michael. Lifto was charge on Wednesday with two counts of criminal vehicular homicide. One of the counts is based on the use of alcohol before the crash, according to Tom Kelly, the Wright County Attorney. The drunk driving charges have not been filed, pending the test results.

Fatal Pickup Truck Crash on I-94 Near Melrose, MN

That was not in time to help the occupants of the Strain Bus Lines Motorcoach.

The Strain Bus Lines Motorcoach was involved in a crash and rollover on I-90 near Austin, Minnesota on November 18th. Capt. Matt Langer of the Minnesota State Patrol reported that it was a “tragic accident because everyone on the bus was either injured or killed.” In addition, Capt. Langer reported that commercial vehicle inspectors and reconstruction specialists would be on the scene examining the evidence of the crash. The cause of the accident will probably take weeks to determine. According to some news sources, there is the possibility that the driver of the bus, Ed Erickson, may have suffered a ruptured aneurysm in his chest and lost consciousness before the crash.

Initial reports are that at least 23 people were on the bus at the time of the crash and that at least 2 people died at the scene.

The crash happened at about 3:30 p.m. on eastbound I-90. The bus crossed over into the westbound lanes, crashed, and landed on its side in the ditch. The interstate was closed to enable medical crews to assist. Seven ambulances and six helicopters responded from the area including, Mayo Clinic, Mercy Hospital, Austin Medical Center, St. Mary’s Hospital (Rochester) and Naeve Hospital (Albert Lea).

According to Freeborn County Chief Deputy Gene Arnold the driver of the bus was critically injured and transported to St. Mary’s Hospital. Arnold also stated that there were not enough ambulances to transport all of the victims.

The bus was owned and operated by Strain Bus Lines Motorcoach Tours, Rochester. It was making its weekly Wednesday shuttle from Rochester, Byron, Kasson, and Blooming Prairie to Diamond Jo Casino in Northwood, Iowa and back. The passengers were mostly senior citizens.

As recently as August of 2008, the bus had some mechanical issues. According to the Federal Motor Carrier Safety Administration, Strain Bus Line has not had a fatal crash for the past two years, but they have had a higher percentage of buses that have been taken out of service compared to other bus companies.

Fatal Motorcycle Crash in Sherburne County

ambulance-2 Fatal Motorcycle Crash in Sherburne CountyThere was a fatal motorcycle crash on Tuesday in Sherburne County. Jeff Skoglund, 49, of Anoka, was killed when his motorcycle was struck by a flat-bed tow truck being driven by Brett Johnson, 44.

The accident happened at the intersection of County Roads 38 and 19. Mr. Skoglund was driving northbound on County Road 19. The tow truck was going east on County Road 38. The accident occurred about 12:05 p.m. The truck driver was not injured according to the County Sheriff’s Office.

The accident is still under investigation.

Fatal Car – Truck Accident on I-35 Near Forest Lake, MN

ambulance Fatal Car - Truck Accident on I-35 Near Forest Lake, MN A fatal accident occurred Sunday morning about 11 a.m. on I-35 and Highway 8, near Forest Lake, Minnesota (Washington County). A Chevy pick-up truck was northbound when the driver lost control and started to roll. It rolled into a southbound Toyota Camry. The car flipped and landed upside down.

The two people from the car were pronounced dead at the scene. They were James Holland, 45, of Chanhassen and his son, Jude Holland, 4.

The driver of the pick-up truck, Eric Sprouse, 19, was ejected from his truck and sustained critical injuries. He was airlifted to North Memorial Hospital where he later died from his injuries. The passenger, Dustin Covey, 20, sustained non life-threatening injuries and was transported by ambulance to Fairview Hospital, Wyoming.

The Minnesota State Patrol, Chisago County Sheriff’s Office, and Forest Lake Police Department were all on the scene. Interstate 35 was completely shutdown for two hours. A medical helicopter landed on the freeway to assist and transported the driver of the truck. Traffic was rerouted to Highway 61. The northbound lanes were reopened about 1 p.m. Southbound lanes were finally cleared and opened about 4 p.m.

Alcohol is not suspected in the accident.

Robert Street, West St. Paul – One Killed, 5 Injured

car-crash-13 Robert Street, West St. Paul - One Killed, 5 InjuredThere was a two-car crash Saturday night in West St. Paul. All six occupants were taken to Regions Hospital where one woman died from her injuries.

At about 9 p.m., a 1997 Chevrolet Cavalier pulled out from the mall parking lot at Robert Street and Marie Avenue, into the path of a 2000 Mercury Mystique. The Mercury broadsided the Cavalier and 2 people were ejected from the broadsided vehicle, including 26-year-old Leslie J. Garvia who died from head and abdominal injuries. Ms. Garvia was not wearing a seat belt.

Another passenger, 26-year-old Jorge Zuniga, was also ejected and suffered non life-threatening head injuries. Zuniga was not wearing a seat belt either. The driver of the Cavalier, Fabio Dierings, and 2 other passengers sustained non life-threatening injuries. Lynette Landrum, driver of the Mercury, of West St. Paul, suffered minor injuries.

Four of the six people involved in the car accident were wearing seat belts. Alcohol is not suspected, according to police.

minnesota-car-crash-1 Minnesota Reserve Officer Mike Wilken Struck and KilledA popular Ramsey County Sheriff’s reserve officer died Sunday morning after being hit near a D.A.R.E. fundraising event in Maplewood, Saturday night at about 8:30.

Michael Wilken, 56, was directing traffic for Fright Farm at the intersection of Frost and White Bear Avenue when he was struck by a car heading north on White Bear Avenue. He suffered many critical injuries, including head injuries, and was taken to Regions Hospital.

Reserve Deputy Wilken had been with the Ramsey County Sheriff’s Office for 10 years, volunteering at hundreds of community events. He loved working the Fright Farm event.

Maplewood Police and the Minnesota State Patrol are investigating the accident. The driver was questioned by officers. There was no indication that drugs or alcohol played a role in the accident.

The bleachers collapsed. Nearly 450 people fell, many sustaining minor injuries. 7 people were transported to the hospital with significant injuries. TSR Injury Law now represents a victim of the bleacher collapse.

The cause of the bleacher collapse is still not known. The city fined the circus for assembling the wooden bleachers without requesting an inspection prior to being used for a public performance. They had not been inspected since they were purchased in 2006. New bleachers have been installed at Circus Juventas and they have passed inspection by St. Paul officials.

Woman Killed in Forest Lake Accident, 100+ Accidents Due to Snow

State Patrol reported more than 100 crashes around Minneapolis-St. Paul from 3 a.m. – 11 a.m. Bridges froze over and roads had patches of ice that were covered with a dusting of snow. MnDOT was out treating trouble spots with salt.

Around 8 a.m., a 45-year-old woman, from Cedar, MN, went off the road in Forest Lake after spinning out on a patch of ice on 35 W North. She left her car to check on another accident victim, was struck by a car driven by a Pine City woman, and was pronounced dead at the scene.

The accident involved three cars that had spun out on northbound 35W near the Forest Lake split. The drivers of vehicle 1 and vehicle 2 got out of their cars to help the third driver, who had rolled his car. It was at that time that a fourth car came onto the scene and fatally struck the woman from Cedar.

Those involved in the accident were: William Franks, 58, of Chaska; Tirrell Corgard, 70, of Roseville; and Maria Wilson, 34, of Pine City; and the unidentified woman from Cedar. The accident is under investigation.

After 30 students had been picked up, Raymond Baar, the driver of a Monarch Bus Service school bus, was driving eastbound and needed to turn left onto Charlton Street. He failed to see a westbound vehicle approaching, turning in front of the Pontiac Gran Prix, resulting in a collision.

Justin Kalenberg, 24, driver of the Pontiac, was transported to Regions Hospital and is in serious condition. Six children were taken to Regions Hospital, as well, where they were treated and released.

The accident occurred about 9 a.m., according to Minnesota State Patrol records. The bus was transporting students to Tarek ibn Ziyad Academy, a K-8 Inver Grove Heights charter school. The impact resulted in the bus going into the ditch. The roof of the car had to be removed, with the “jaws of life”, to get the driver out. State Patrol reported that the driver was conscious and talking by the time he was extricated.

State law requires a bus driver to pass a written test, road test, and physical exam. Additionally, their criminal history and driving record are pulled and checked each year. Minnesota State Patrol will review the bus driver’s records to determine whether he was qualified to drive. Baar is on leave pending the investigation.

Oakdale police reported that Stacey Morgan, 33, must have realized that she was going to be struck from behind, because at the last second she shoved the baby stroller away from danger. Her daughter was ejected from the stroller, but since she was strapped into a car seat on top of the stroller, she was uninjured.

The accident happened in the 6900 block of 29th Street, in Oakdale, just before 8 a.m. Ms. Morgan was running east on 29th Street. A 16-year-old male was driving a 1997 Infiniti, in the same direction, and struck Ms. Morgan from behind.

Ms. Morgan sustained serious head injuries and was transported to Regions Hospital. She died a short time later.

Minnesota State Patrol will help further investigate the incident. Alcohol is not suspected as a factor in this tragedy.

The injured cyclist is Mark H. Williams, 53, of Waldorf. He was airlifted to St. Mary’s Hospital, Rochester. He sustained multiple injuries. The garbage truck driver was not injured.

State Patrol reported that the motorcyclist was not wearing a helmet. They will continue to investigate the accident.

car-crash-11 Lino Lakes Fatal Four-Car Chain Reaction Crash on 35ETragedy has struck again near Hugo on I-35E northbound. The traffic was heavy due to construction. Apparently a 19-year-old driver was inattentive, crashing her Honda Civic into a VW Cabriolet.

The Civic was doing highway speeds and the force of the impact pushed the VW into a Ford pickup truck, which then hit the next vehicle in line, a Chevy Cobalt. The vehicles were strewn across the interstate and off the road.

The 32-year-old driver of the VW was taken to North Memorial Hospital in critical condition. She passed away early Wednesday morning. She was from Hugo. According to the State Patrol, three other people involved in the crash sustained minor injuries.

Interstate 35 northbound was shut down for three hours due to the crash. The accident is under investigation. Alcohol does not seems to be a factor in the crash.

There were 3 vehicles waiting at a signal light on Hwy 8 at Johnson Lane. When the light turned green, they started to accelerate when they were rear-ended by a fourth vehicle, a 2000 Buick Century. According to the State Patrol, the fourth vehicle was traveling at highway speed.

The accident is under investigation. It did not appear to be alcohol-related.

Overall, the Labor Day weekend was relatively safe. The Minnesota State Patrol said that this was the only fatal accident this weekend. It was a significant drop from the 14 people killed in car crashes over Memorial Day weekend.

Michael Reynolds, 49, was driving on County Road 11, near MN Highway 84, when he veered, lost control, and flipped his vehicle. His father, Marvin Reynolds, 72, was thrown from the front passenger seat. He was pronounced dead at the scene.

Michael and Elizabeth Reynolds, his 70-year-old mother, were transported to St. Joseph’s Medical Center in Brainerd. Their condition is unknown.

The Minnesota State Patrol and Cass County Sheriff’s Office are investigating the accident.

The police officer, Sgt. Charles Gollop, was taken to Hennepin County Medical Center with head injuries, multiple fractures, and possibly a punctured lung. The other driver, David McArthur of Bloomington, was treated at Fairview Southdale and released. The collision is being investigated.

(PRWEB) September 2, 2009 — Rich Ruohonen, TSR Injury Law partner and Minnesota Super Lawyer, represented a woman named Sabina Babaca for injuries suffered in a car crash near Barron, Wisconsin, on October 7, 2005.

According to court records, Babaca was a passenger in her husband’s vehicle being driven on Highway 8. Her husband attempted to pass a vehicle, in a legal passing zone. A truck pulled out onto the highway into his path causing an immediate collision.

Ms. Babaca had to be extricated by emergency personnel. It is on record that she suffered a left radial arm fracture requiring open reduction internal fixation with the use of a plate and 6 screws. The fracture caused a mild radial nerve injury resulting in ongoing pain. She also sustained a shoulder soft tissue injury on the same side.

The record reflects that Babaca incurred approximately $100,000 in medical bills and wage loss, most of which were paid by no-fault. The defendant offered $85,000 to settle this case prior to trial. The defendant’s insurance company, Erie Insurance, hired an accident reconstruction expert to testify at trial. Court records show that during cross examination, Ruohonen was able to get the following strategic admissions from this expert:

  • that Mr. Babaca was not speeding at the time of the collision
  • that by the time Adams pulled out it was too late for Mr. Babaca to stop to avoid the collision
  • that Mr. Adam’s was not fully in the lane upon impact (demonstrating Mr. Adams had just pulled out at the time of the collision)

It is on record that the jury found 75% fault on Adams and 25% fault on Mr. Babaca. The jury awarded $80,723.71 in past medical expenses, $19,440 in past wages, $80,000 in past pain and suffering, and $36,800 in future medical expenses. The total verdict was $216,163.71. Erie Insurance paid $162,122.7 (75% of the verdict) plus an additional amount for costs and interest owed.

The total paid was approximately double the final offer made by Erie Insurance prior to trial. This is believed to be one of the largest Plaintiff’s verdicts in Barron County, Wisconsin in several years.

Her 88-year-old aunt, Rose Bongiovanni, of St. Paul, was taken to Regions Hospital, where she later died. Saturday, in Carver County, a three-vehicle fatal accident took the lives of two people and injured four others, including 3 children. Two of the three drivers died in the chain reaction semi truck crash, Sandra Babatz, 45, of Norwood Young America, and Juan Overa, 35 of Sullivan, Texas.

Semi truck driver Gordon Curtiss, 52, of Hutchinson, was traveling east on Highway 212 in a 2007 Kenworth semi truck. Sandra Babatz was also going east driving a 2003 Pontiac Vibe. Highway 212 is just two lanes at that point, Babatz stopped on the highway to make a left turn off the highway, onto CR 51 going north. Babatz was rear ended by Curtiss and pushed into the other lane of traffic. She was broadsided by a 1999 Chevrolet pickup truck driven by Olvera.

According to the Minnesota State Patrol, 59-year-old Carolyn Anderson was stopped on Hwy 61, near Hugo, waiting to turn left, when she was rear-ended by a semi truck. Ms. Anderson died at the scene and an 88-year-old passenger, Rose Bongiovanni, died after being taken to Regions Hospital. A third person in the minivan, Marlene Wanner, 72, is in critical condition at Regions Hospital.

Hwy 61 was closed, in both directions, for three hours. The impact pushed the van into the ditch and the semi truck was angled across the highway. It is still too early to tell if the accident was driver negligence, mechanical malfunction, or speed-related.

The 32-year-old semi truck driver was not injured. He had a clean driving record. The accident is under investigation and charges may be filed.

A 17-foot power boat t-boned a boat carrying eight passengers from New Mexico. The Beltrami County Sheriff’s office said that the driver, John Harstad, 46, of Eden Prairie, is suspected of being drunk at the time.

bridge-collapse State of Minnesota Filed Suit Against URS for I-35 Bridge CollapseThe State of Minnesota filed a lawsuit in Hennepin County, Wednesday, against URS Corporation, the state’s I-35 bridge consultant. The suit alleges negligence and breach of contract by URS because they failed to inspect, analyze and evaluate the span’s soundness. In the suit, the state is also asking for URS to reimburse the state more than $37 million in payments made from special victim’s compensation funds and any damages the state may have to pay Progressive Contractors Inc., the construction company that was working on the bridge.

The state alleges that the URS contract specifically required the company to develop tension and compression failure criteria for the bridge’s many components — including the steel gusset plates — using data from how they were supposed to be designed.

URS Corp. is a San Francisco based firm, that had assured the state of its expertise in assessing the need for repairs and the best way to go about doing the repairs. Furthermore, in 2005, URS reported to the state that if “gusset plate buckling occurs, it will not be catastrophic.” In a communication from the corporation in 2006, they told MN-DOT that they would not calculate actual capacities of all of the connections even though that would provide the most accurate results. They said it would be too much work. They proposed to do some approximate but conservative adjustments to the member capacities per design specifications.

The National Transportation Safety Board report, from November 2008, stated that the gusset plates installed when the bridge was built in the 1960s were too thin, and the failure of the plates was a probable cause when the bridge collapsed. The board also stated that findings had pointed to both the bridge’s original flawed design and the spacing of construction materials on the bridge as causes for the collapse.

The 4th of July weekend started with 2 fatalities in a car crash in Olmsted County on Friday, at 3:30 p.m.

60 year-old Steven Friese, of Minnesota City, and 67 year-old Fay Friese, of Arcadia, Wisconsin were traveling west on Highway 14 when they were hit and killed by a car heading north on County Rd 7 and driven by 29 year-old Jason Benton, of Plainview, Minnesota.

The driver of the car and 2 passengers in Friese’s van suffered minor injuries. The accident is under investigation.

DWI Patrols Increased for Holiday Weekend

In an effort to NOT repeat the Memorial Day accident statistics, the Minnesota Department of Public Safety announced on Thursday that State Patrols will be prolific and diligent this weekend — against drunk drivers. The department will conduct Operation NightCAP (night time concentrated alcohol patrol) in a thirteen county area: Anoka, Blue Earth, Crow Wing, Dakota, Hennepin, Itasca, Ramsey, Rice, St. Louis, Sherburne, Stearns, Washington, and Wright. (They will also crack down on seat belt violations. Citations may now be issued even if there are no other violation.)

Last 4th of July weekend, 70% of the deaths were alcohol-related. There were nearly 2,000 arrested and charged with driving while intoxicated. Operation NightCAP was very effective last year, issuing nearly 150 seatbelt citations and nearly 200 DWI arrests.

Star Tribune Truck Hit by Drunk Driver

A Star Tribune delivery truck was broadsided by a Geo Prism, that ran a red light, early Monday morning. It happened at Washington Avenue North and 10th Avenue North, just around the corner from the distribution center.

The driver of the Prism tried to flee the scene, but was found and arrested under suspicion of driving under the influence. One person in the car was taken to Hennepin County Medical Center with serious injuries. The truck driver was not injured.

Sgt. Jesse Garcia of the Minneapolis Police Department said, “A drunk driver went through a red light and basically caused this accident.” The driver was identified. “He does have some priors, and he does have some alcohol-related charges on his driving record,” said Garcia. “So, you know, it sounds like someone that has issues with alcohol.”

work-explosion-1 Workplace Explosion LorettoA Loretto semi-trailer truck repair business had a blast Monday morning. A 20’ high hole was blown out of the side of the facility in an explosion, sending three employees to North Memorial Medical Center, Robbinsdale, with minor injuries.

According to Medina Police Chief Ed Belland, the workplace accident happened when employees, at Gary’s Diesel Service, attempted to remove the top from a 1,000 gallon fuel tank. The explosion happened at about 11:30 a.m. Monday morning. The building then caught on fire. Firefighters from Loretto, Maple Plain, and Hanover responded to the call and were able to put the blaze out quickly.

67-year-old Carolyn Muckerheide, of St. Cloud, Minnesota, was pronounced dead at the scene. Her 74-year-old husband, Eugene, was stabilized at the scene and flown to Theda Clark Medical Center for medical treatment for his serious injuries.

The driver of the SUV and her 2-year-old son were not injured in the accident. Police are continuing to investigate the accident.

ambulance Ambulance Crashes in MinneapolisThis weekend there were two more car crashes involving HCMC ambulances — on the heels of an ambulance accident last weekend where a pedestrian was killed. These two crashes were within minutes of each other. The second ambulance was responding to the first ambulance crash when it was hit by a drunk driver.

The first accident happened in North Minneapolis. The ambulance had its lights and siren going. A taxi cab failed to yield at the corner of Lyndale Avenue and Highway 55; the ambulance crashed into it. The cab driver was sited for failing to yield to an emergency vehicle.

The call was made that an ambulance was needed to take the taxi driver and his two passengers to the hospital, one passenger in serious condition. As the ambulance was driving to the accident, it was hit by a drunk driver, in a minivan, with no headlights on. The driver was arrested on suspicion of drunken driving.

In total eight people were involved in the two accidents. The four paramedics sustained minor injuries, two people were hospitalized with non-life-threatening injuries, and one woman is still in serious condition at HCMC.

car-crash-12 Deadly Weekend in Twin CitiesIt continues to be a deadly weekend in the Twin Cities. Police are now investigating a St. Paul accident that occurred on Saturday morning. Officers and paramedics were called to Payne Avenue and Parkway Drive after someone reported an SUV / car accident.

The 19 year-old driver of the car was pronounced dead at the scene. The name of the driver is not being released pending family notification. The female driver of the SUV sustained serious injuries and was taken to Regions Hospital. The male passenger suffered minor injuries and was also taken to Regions Hospital.

Witnesses reported that the car was traveling at a high rate of speed as it entered the intersection, after failing to stop at the stop sign. The SUV had just stopped at the stop sign and proceeded to make a left turn onto Payne Avenue when it was struck by the car. There were no obvious signs of drugs or alcohol use involved in the car crash, according to police spokesman, Paul Schnell.

According to the Anoka county Sheriff’s Office, witnesses reported that Kopka was northbound and tried to turn left when the southbound SUV struck her vehicle. She was killed instantly in the crash. The 44 year-old male driver and 48 year-old female passenger were taken to Mercy Hospital, Coon Rapids. Their injuries appeared to be not life-threatening.

The SUV / car accident will continue to be investigated by the Sheriff’s Department and the Minnesota State Patrol.

As she went to cross Sibley Street, toward Mears Park, she was struck by a garbage truck turning left from 5th Street north onto Sibley. She was struck in the crosswalk at 5:53 a.m. Friday morning.

Jean Matzke was known and loved by a wide variety of people. Most recently, she has been known in the neighborhood as a dog walker and a dog lover. Two years ago she adopted an injured boxer. She formerly owned an art gallery in St. Cloud, was an instructor at St. Benedict’s, and was a top textile artist in Minnesota. She earned many accolades for her textiles.

A full investigation is under way and could take 4-6 weeks, according to police spokesman Sgt. Paul Schnell. The accident occurred 30 minutes after sunrise and that may have played a factor. Many times drivers, going east, are blinded by the sun. Officer Schnell said the driver was obviously distraught. The garbage truck driver was tested for drugs and alcohol, but showed no signs of impairment. He had a green light. It is unclear whether Ms. Matzke had the “walk” light.

child-injury-1 Child Injury DrowningNew Brighton police and Ramsey County Water Patrol were called around 2:30 p.m., Wednesday afternoon about a possible drowning near a Long Lake beach. A 6-year-old-boy was unresponsive after being rescued from 8’ deep water.

The boy was found, by lifeguards, within minutes of being reported missing. He was given CPR and taken to Gillette Children’s Specialty Healthcare, in St. Paul, and is listed in critical condition. No further information is available at this time.

The boy was on a field trip with a group from Roseville schools. The beach was closed for the rest of the day. Authorities continue to investigate the incident.

Lakeville, MN Man Killed in Auger

A 49 year-old man, working at Country Stone and Soil, a Lakeville, Minnesota company, died in a work-related accident Saturday. His name has not been released pending notification of next of kin.

The man was feeding mulch into a hopper leading into an auger assembly. The auger became clogged. While attempting to clear the clog, he fell into the auger and was killed. He was pronounced dead at the scene.

The accident will continue to be investigated by a wide array of departments, including Dakota County Sheriff’s Office, the M.E., and work safety and health officials.

The driver was thrown over the guardrail from northbound Highway 169 and landed on Highway 101. This was confirmed by Scott County dispatch. The Minnesota State Patrol is investigating the accident.

It is reported that the motorcyclist lost control of his motorcycle, was hit by a car, and flew over the guardrail, falling at least 15′ to the road below.The victim survived the crash and was taken by ambulance to an area hospital. His condition remains unknown, although he is expected to survive.

Cambridge Man Hit by Train

train Cambridge Man Hit by TrainA train accident was reported early Friday morning. A man was struck and killed by a northbound train east of downtown Cambridge, Minnesota, about 6:00 a.m. It happened near Hwy 95.

The name of the 29 year-old is being withheld pending relatives being notified. An eyewitness said there was at least one of the train cars off the tracks and the road was blocked for part of the morning.

It was a 64-car Union Pacific train that had departed Des Moines, Iowa at about 3:20 a.m. Cambridge was its final destination, said railway spokesman Tom Lang. It was reported that 47 of the cars were empty and none of the train cars were carrying any potentially hazardous cargo.

35W Bridge Collapse Lawsuits

The pro bono suits with the State of Minnesota are wrapped up. On June 18th, 79 lawsuits were filed, on behalf of 93 victims of the 35W bridge collapse, against URS Corp., a global engineering company, and Progressive Contractors Inc., a local construction company. The lawsuits, claiming the two companies’ negligence led to the 35W bridge collapse, were served Wednesday by the victims, survivors, and relatives of those involved in the catastrophe.

This wave of lawsuits represents the largest litigation following the August 1, 2007, disaster, which killed 13 people and injured 145. More lawsuits are expected. These additional suits have caused some negative comments from the community, questioning how much people deserve. Below is a response from a struggling, broken-hearted wife:

As someone who lost their spouse on this bridge, I again feel compelled to respond to these [negative] comments and what I perceive as most readers ignorance. First of all, I am represented by the consortium and when they say pro bono, they mean pro bono! They have not asked for or taken one penny of our settlements from the state, so cut them a break, please. And when it comes to our loss and money, who are you guys to judge how much we deserve for our loss. You people who haven’t lost anyone in a sudden or tragic way. My husband left for work on the bridge that morning and never came home. Let me repeat that. HE NEVER CAME HOME! So lay off us victims and family members. URS, the engineering firm that inspected the bridge for MNDOT and PCI, the construction company that was working on the bridge deck at the time of the collapse, are being sued for alleged “wrongdoing”. The complaint further says that both companies “breached duties” to the public and Minnesota motorists. No dollar amounts have been disclosed, but it can be assumed it is in the tens to hundreds of millions.

The lawsuits are meritorious and supported by the finding of the National Transportation Safety Board. In November 2008, the NTSB reported that the bridge collapsed because the steel gusset plates were only half as thick as they should have been when the bridge was designed in the 1960s. The board also cited that the bridge was further stressed, and deemed as a factor, by the additional weight of construction equipment and materials placed on the bridge that day by PCI.

Drunk Driving Pedestrian Accident

auto-accident-victim-1 Drunk Driving Pedestrian AccidentA Minneapolis woman, who may have been under the influence of alcohol, drove into a pedestrian and a Metro Transit bus shelter early Sunday morning. The pedestrian was taken to Hennepin County Medical Center with massive head injuries and probable traumatic brain injury.

The pedestrian has been identified as Christopher S. Iverson, 48. He was standing at a bus stop on East Lake Street at 39th Avenue just after midnight.

The driver, a 49-year-old Minneapolis woman, was taken to the Hennepin County jail on pending criminal vehicular injury charges. Police spokesman Sgt. William Palmer suspects this accident was alcohol related. The exact blood-alcohol concentration will not be available for a few weeks. The speed of the car has yet to be determined.

35W Bridge Collapse

We are now handling six personal injury cases from the bridge collapse disaster. These cases should go to trial in June.

It has been almost two years since the Interstate 35W bridge collapse and the bridge girders are still littering Bohemian Flats parkland in Minneapolis. The wreckage covers 7 acres of the park. The Minneapolis Park and Recreation Board would like them moved because it is costing them in lost revenue — $16,000 annually from a pay parking lot and $20,000 in fees from a private excursion boat company that cannot operate from the park.

There are lawsuits pending from 117 survivors and relatives of victims from the bridge collapse. They want — and need — the girders preserved in place. The waste land of steel is evidence that can be used to prove their cases for legal liability. The girders are arranged in a way that replicates their position before the collapse. They still have visual impact.

The court said MnDOT could move the wreckage, but the court is not willing to order the legal protection for the move that MnDOT was seeking.

East Bethel has hopped on the wagon with Princeton and other small cities requiring caterers to have a permit to serve alcohol at private events. The new ordinance takes effect Friday, June 12th. They hope that it will keep a tighter rein on alcohol sales from illegitimate caterers at events.

“When there’s liquor involved, it behooves us to make sure our public safety people know,” said East Bethel City Administrator Doug Sell. “It’s also important for the city to know that the individuals serving alcohol are properly insured. Hopefully there’s not an issue but you would hope that they’re properly insured.”

“What they’re concerned about is that people will come in and put a bowl of Fritos out there and chip dip and use that as the excuse to sell food as a foot in the door to sell booze,” said East Bethel City Attorney Jerry Randall. “Cities want to make sure they are legitimate food service operators, not just a pretext to sell booze.”

Caterers are normally licensed by the state and hold liquor licenses in their home municipalities. In the past they have been able to sell liquor in another city without being subject to the same local liquor ordinances that apply to established bars and liquor stores. Now caterers will be required to pay a nominal fee and submit an application and show proof of:

  • valid, state-issued caterer’s permit
  • primary liquor license
  • current insurance policy
  • contract with a local customer

Violations could result in misdemeanor charges being filed.

Golden Valley Therapist Surrenders License in Minnesota

Judith Henderson, a Golden Valley psychologist, has given up her license to practice after being accused of taking a patient shopping, traveling, dining, and theater excursions then billing the activities as therapy.

The Minnesota Board of Psychology says the 68-year-old charged more than $300,000 in fees to the patient over 10 years. Henderson does not admit or deny the allegations, but agreed to give up her license.

Ms. Henderson violated her professional relationship with the patient, the board stated, by extravagant socializing and then billing it as therapy. She allowed, and possibly encouraged, an inappropriate dependence by the patient.

Fatal Motorcycle Crash on I-394 & Hwy 100

A motorcyclist died Friday about noon, in Golden Valley. He crashed his motorcycle into a guardrail on an off-ramp and flipped over the wall. The Minnesota State Patrol said that speed was a factor in this fatality.

The State Patrol said that because of the speed he was going he hit the wall and went flying, while the motorcycle continued down the ramp. The crash is under investigation; the motorcyclist has not been identified.

Car-Accident-Zane-Ave.-N.-9-25-03-001 Car Accident: Rollover Near Monticello June 5A Buick Regal was eastbound on Interstate Highway 94, near Monticello, when it rolled over and ended up in the left lane. The driver got out of the car and then the Buick was hit from behind by a Honda Civic.

The driver of the Civic was not injured, but at least one of the persons in the Buick was killed. It has not been reported whether the driver, the passenger, or both were killed.

Drunk Driver Crashes in Savage June 4

How would you like to be sitting in a bar and end up with an SUV on your lap? That is what happened at McHugh’s Grille and Bar in Savage, Minnesota, Scott Co at 5:40 pm, Thursday evening.

The driver crashed through the front entrance of the bar. One employee had minor injuries.
The police said the driver of the SUV was drunk. He was arrested and booked into the county jail. Charges are expected to be filed Friday.

Garbage Truck Accident

A commercial waste management truck rolled over Harris Nyumah, a 5-year-old who came from Liberia 3 years ago, and killed him instantly. The garbage truck accident occurred at about 11 a.m., on Thursday morning, near the intersection of 51st Ave. N and Ewing Ave. N.
Harris had been playing outside. He darted after his ball as it rolled into the street. The garbage truck was backing up and the driver could not see the boy.

The boy died at the scene and his body was taken to the Hennepin County Medical Examiner’s office. The garbage truck accident is still under investigation. The driver of the garbage truck is cooperating fully with the investigation and is said to be devastated. “At this point, I don’t anticipate any charges, but things could always change,” Commander Mike Reynolds said.

MN Car Crash Leaves 1 Dead, 3 in Serious Condition

car-crash-2 Minnesota Fatal Car CrashA 2004 Pontiac Aztek and a 1995 Pontiac Grand Prix were involved in a head-on collision Tuesday about 3 p.m.. The highway had to be closed for several hours. The state patrol said that the car heading north on Hwy 169 crossed into the southbound lanes, causing the car accident.

Eyewitnesses said at least one person was trapped inside one of the vehicles and had to be extracted. Two females and one male were taken to HCMC with serious injuries. A fourth person was pronounced dead at the scene.

In 2005, head-on car crashes accounted for only 2% of the accidents but 10% of the fatalities. The impact of a head-on car crash between two vehicles, each traveling at 50 m.p.h., is equivalent to hitting a stationary car at 100 m.p.h.

Deadly Motorcycle Accident

Late Saturday night, May 23, a speeding motorcycle ran into the back of a Nissan Altima; killing both people on the motorcycle. The driver of the Nissan did not sustain visible injury.

The vehicles were going west on Hwy 55, when the Kawasaki crashed into the car. The attending officer said the motorcycle was traveling at a “high rate of speed”. The motorcycle /car accident closed the Mendota Bridge for 4 hours.

This has been a deadly weekend for Minnesota motorists. We have had 7 crashes, with 10 fatalities. It is disheartening for police officers.

Deadly Car Accidents Memorial Weekend

This is the deadliest weekend on record in years. The state has an average crash fatality of 2-3 per weekend. There have been 11 killed this weekend and it is only half over. Officers are lamenting the lack of responsibility and the needless loss of life.

The most lives were lost in the 2-vehicle car accident in Olmsted County. A minivan was broadsided and spun around by a Silverado, leaving 4 dead. The cause of the accident is alcohol-related according to police. There was another drunk driving fatality involving an underage driver. The victim in that accident was only 17 years old. In total 4 of the 7 crashes involved alcohol.
